Scope of these conditions

The general terms and conditions (hereinafter referred to as GTC) apply to all offers, contracts, orders and services from Imagify OG. By ordering or using a service, the terms and conditions are considered read and accepted. They also apply to future business relationships between the contracting parties, even if they are not expressly included again in the subsequent agreement.

Imagify OG Services

Imagify OG will carry out the orders placed carefully and after detailed planning.
Unless the client provides written instructions, Imagify OG is free as to how the order is carried out.

Rights of use

Imagify OG is the author as defined by law. However, Imagify OG transfers to the customer the permission to use the photos, photographs, files and other digital works belonging to the subject matter of the contract for an indefinite period of time.

All of the above rights of use are transferred to the customer upon full payment of the agreed fee. All photos, files and data carriers remain the property of Imagify OG until full payment has been made

Prices & payment terms

All offers on the website are non-binding. Price changes can be made with immediate effect.
The prices of the services are in EURO (EUR) including VAT.

No down payment has been agreed upon conclusion of the contract. The fee agreed between the parties is payable within 5 days of invoicing.

Additional costs and expenses required to carry out the order, such as travel expenses such as taxis to hard-to-reach places, accommodation costs in hotels, ferries, bus trips or parking garage costs, are borne by the client.

Customer's obligations to cooperate

The customer must ensure that employees receive all information required to carry out the order in good time (directions, special requests, etc.).

If Imagify OG is booked for an event or other event, the customer will name Imagify OG a person and contact details who will be available to him as the responsible contact person for inquiries during the relevant event and 3 hours before the start of the event.

The customer is responsible for ensuring that the persons, objects and locations required to carry out the order are available or accessible.

The photographer's artistic freedom

The customer is advised that photos and photo works are always subject to Imagify OG's artistic scope. Complaints and/or complaints regarding Imagify OG's artistic freedom are therefore excluded.
Subsequent requests for changes by the customer require a separate written agreement and are to be paid separately.

Customer's resignation

With the written confirmation (email + signed offer) of the delivered offer, an order is already considered booked and the terms and conditions have been agreed. If the order is not completed after the right of withdrawal of 14 days, 30% of the fee is due.

Imagify OG's liability

Imagify OG is only liable for intentional and grossly negligent conduct. The limitation of liability also applies to the conduct of Imagify OG employees and assistants. If we know 24 hours before the event that Imagify OG will be cancelled due to serious illness or accident, we will do our best to find a replacement. However, should Imagify OG not show up on the way to the event due to force majeure, i.e. accident or traffic jam, etc. or be late, Imagify OG cannot be held liable or claims for compensation can be made.

Complaints

The client is obliged to check the delivered products and services for completeness and accuracy immediately upon receipt.
Any damage or complaints regarding the content, quality or condition of the image material or the goods must be reported in writing within 7 days of receipt. Otherwise, the image material or the goods are considered approved.

After receiving the photos, the client is solely responsible for the proper storage and backup of the files. It is recommended that you back up to at least one additional disk. With every order, Imagify OG delivers the photos and possibly videos as a wetransfer link, which remains online for at least 1 week.

Data protection/data security

Imagify OG undertakes to publish photographs only with the consent of the persons depicted. At events or weddings, the client or the bridal couple must obtain the consent of the persons present and are solely liable for this.
Jurisdiction and Applicable Law

The exclusive place of jurisdiction and fulfilment is the registered office of Imagify OG. (Vienna)
