Scope of These Terms

These General Terms and Conditions (hereinafter referred to as the "Terms") apply to all quotes, contracts, orders, and services of Imagify OG. By placing an order or using a service, you acknowledge that you have read and accepted these Terms. They also apply to future business relationships between the contracting parties, even if they are not expressly incorporated again into the later agreement.

Services of Imagify OG

Imagify OG will carry out the orders it receives with care and after detailed planning.
Unless you provide written instructions, Imagify OG is free to decide how the order is carried out.

Rights of Use

Imagify OG is the author within the meaning of the law. However, Imagify OG grants you a license to use the photos, images, files, and other digital works that form part of the subject matter of the contract for an indefinite period.

All of the above rights of use pass to you upon full payment of the agreed fee. All photos, files, and storage media remain the property of Imagify OG until payment has been made in full.

Prices & Payment Terms

All offers on the website are non-binding. Prices may be changed with immediate effect.
The prices for our services are stated in euros (EUR) and include VAT.

No down payment is agreed upon conclusion of the contract. The fee agreed between the parties is payable within 5 days of the invoice date.

Additional costs and expenses required to carry out the order, such as travel costs (for example taxis to hard-to-reach locations), hotel accommodation, ferries, bus fares, or parking garage fees, are borne by you.

Your Duty to Cooperate

You must ensure that our team members receive all information required to carry out the order in good time (directions, special requests, etc.).

If Imagify OG is booked for an event or other function, you will provide Imagify OG with the name and contact details of a person who will be available as the responsible point of contact for questions during the event and for 3 hours before it begins.

You are responsible for ensuring that the persons, items, and locations required to carry out the order are available and accessible.

Artistic Freedom of the Photographer

Please note that photos and photographic work are always subject to the artistic discretion of Imagify OG. Complaints and/or notices of defects regarding the artistic discretion exercised by Imagify OG are therefore excluded.
Subsequent change requests require a separate written agreement and are billed separately.

Cancellation by the Customer

Upon written confirmation (email + signed quote) of the quote we have sent, an order is considered booked and these Terms are deemed accepted. If the order does not proceed after the 14-day right of withdrawal has expired, 30% of the fee is due.

Liability of Imagify OG

Imagify OG is liable only for willful misconduct and gross negligence. This limitation of liability also applies to the conduct of employees and agents of Imagify OG. If we become aware 24 hours before the event that Imagify OG will be unable to attend due to serious illness or accident, we will make every effort to find a replacement. However, if Imagify OG fails to appear or arrives late due to force majeure, such as an accident or traffic congestion on the way to the event, Imagify OG cannot be held liable and no claims for damages may be asserted.

Complaints

You are obliged to check the delivered products and services for completeness and accuracy immediately upon receipt.
Any damage or complaints regarding the content, quality, or condition of the image material or goods must be reported in writing within 7 days of receipt. Otherwise, the image material or goods are deemed approved.

After receiving the photos, you are solely responsible for properly storing and backing up the files. We recommend keeping a backup on at least one additional storage medium. For every order, Imagify OG delivers the photos and, where applicable, videos via a WeTransfer link that remains online for at least 1 week.

Data Protection / Data Security

Imagify OG undertakes to publish photographs only with the consent of the persons depicted. At events and weddings, the customer or the couple must obtain the consent of the persons present and depicted and is solely liable for doing so.
Place of Jurisdiction and Applicable Law.

The exclusive place of jurisdiction and place of performance is the registered office of Imagify OG. (Vienna)
